Director of Racing

The General Manager of RST is appointed in the statutory role of Director of Racing, with the following functions, responsibilities and powers

  1. 1. The Director of Racing is responsible for -
    1. a. regulating and controlling racing to ensure that it is conducted with integrity; and
    2. b. monitoring the administration of racing; and
    3. c. researching and investigating racing integrity and related matters; and
    4. d. advising the Minister on racing integrity and related matters and making appropriate policy recommendations for the development of racing; and
    5. e.liaising with authorities and persons responsible for racing and related matters in this State and, as appropriate, elsewhere; and
    6. f. representing the State and the local industry on national bodies and in national forums generally concerned with racing integrity and related matters; and
    7. h. providing administrative support to the TRAB; and
    8. j. such other functions as are imposed on the Director by this or any other Act.
  2. 2. The Director of Racing is also responsible for -
    1. a. controlling race nominations, acceptances, field selections, handicapping, barrier draws and scratchings in harness racing; and
    2. b. controlling race nominations, gradings, field selections, box draws and scratchings in greyhound racing; and
    3. c. providing advice and recommendations to the TRB on the Rules of Racing; and
    4. d. ensuring that the Rules of Racing for all codes of racing are properly enforced by stewards; and
    5. e. approving registrations under the Rules of Racing; and
    6. f. granting licences under the Rules of Racing.
  3. 7. The powers of the Director of Racing are -
    1. 1. The Director has power to do such things (other than employ persons) as the Director considers necessary or convenient for or in connection with the exercise or performance of any power or function conferred or imposed on the Director by this or any other Act.
    2. 2. Without limiting the generality of subsection (1), the Director may -
      1. a. hold inquiries; and
      2. b. maintain registers of clubs, bookmakers and bookmakers' agents; and
      3. c. give directions to registered clubs, either individually or collectively; and
      4. d. give directions to registered bookmakers, either individually or collectively, including directions about how they may advertise; and
      5. e. give directions to bookmakers' agents and other persons involved in the racing industry, either individually or collectively; and
      6. f. require a registered club or registered bookmaker to furnish the Director with specified information within a specified time and in a specified manner; and
        (fa) determine, after consulting with the TRB, the number of stewards required to -
        1. i. officiate at race meetings; and
        2. ii. officiate at race trials; and
        3. iii. perform any other functions pursuant to the Rules of Racing.
        (fb) determine, after consulting with the TRB, the nature and level of swabbing of racing animals and participants to be undertaken; and
        (fc) determine after consulting with the TRB, licence and registration fees pursuant to the Rules of Racing and;
      7. g. apply, towards the costs of administering this Act, any of the following payments received by the Director or on his or her behalf:
        1. i. payments forfeited under section 22J and 34;
        2. ii. registration fees under this Act;
        3. iii. registration and licensing fees under any Rules of Racing;
        4. iv. fines imposed by stewards under any Rules of Racing;
        5. v. fines imposed by the Director under this Act;
        6. vi. proceeds from the sale of any goods or the provision of any services;
        7. vii. such other payments as the Minister may approve.

 Some amendments will have affect from 1 August 2009 while others will not be affective until 1 September 2009.
